Add this to another station Taking Your Property: New High Court Ruling (9.23MB; download) -- Until today, government could only take your property by eminent domain for clear public use. Clear public use previously meant building things like schools or roads. The Supreme Court has just expanded governmentÂ’s power to take your property. Today in a Connecticut case the Court ruled that clear public use can include shopping malls and apartment developments. The city of New London, Connecticut wanted to condemn some private homes to clear the way for an office development. City officials said the economic growth that would come from the office development could be defined as public use. The city argued that public use outweighed the rights of the homeowners who will be displaced. By a slender 5 to 4 majority, the US Supreme Court agreed with the city and ruled against the homeowners. What are the implications here in Washington State? Does this revise the meaning of the words public use in the 5th Amendment to the constitution? What do you think?
